1. Legal defence of the prosecuted person in misdemeanor / infringement cases

The Act II of 2012 on misdemeanors, misdemeanor proceedings and the registration system of misdemeanors regulates several cases in connection with offences against traffic regulations separately, qualifying them as demeanors.

Legal defence may be important particularly in the following cases:

  • Driving under prohibition (Section 176)
  • Minor violation of traffic regulations (Section 224)

Government regulation No. 218/1999. (XII.28.) on misdemeanors specifies further infringement cases in the field of traffic regulations, where legal representation may also be needed as well:

  • DUI – driving under the influence of alcohol (Section 42)
  • Breach of the obligation of giving way or yield (Section 44)
  • Violation of road traffic order (Section 46)
  • Driving without a valid driver’s licence (Section 47) etc.

The Act II of 2012 on misdemeanors, misdemeanor proceedings and the registration system of misdemeanors establishes that the aggrieved party may practise his/her rights through a legal representative.
